Mistrial Declared in Lindsay Clancy Triple-Murder Trial After Hung Jury


PLYMOUTH, Mass. — A Massachusetts judge declared a mistrial Friday in the closely watched case of Lindsay Clancy, the former labor-and-delivery nurse charged with killing her three young children, after jurors said they could not reach a unanimous verdict.


Judge William F. Sullivan formally ended the trial on September 4, 2026, following seven days of deliberations totaling about 38 hours. The jury of nine women and three men sent multiple notes reporting they were deadlocked. Their final message stated they reported the impasse “with a heavy heart” and would not be able to decide.


Clancy, 36, does not deny strangling her children—Cora, 5; Dawson, 3; and 8-month-old Callan—with exercise bands in the basement of the family’s Duxbury home on January 24, 2023. She then cut her wrists and neck and jumped from a second-story window in an apparent suicide attempt, suffering spinal injuries that left her paralyzed from the waist down. She has been held at Tewksbury State Hospital since 2023.


The central question at trial was not whether she committed the acts, but whether she was criminally responsible. Her defense, led by attorney Kevin Reddington, argued she was in the grip of postpartum psychosis and bipolar disorder, heard a commanding voice telling her to kill the children and herself, and lacked the capacity to appreciate the wrongfulness of her actions or conform her conduct to the law. Prosecutors from the Plymouth County District Attorney’s office, led by Timothy Cruz, contended she planned the killings, sent her then-husband Patrick out of the house on errands, and understood what she was doing.


The roughly six-week trial featured more than 70 witnesses, including family members, treating clinicians, and competing forensic psychiatrists. Evidence showed Clancy had sought help repeatedly in the months after Callan’s birth in May 2022. She was prescribed a large number of psychiatric medications by multiple providers who did not always coordinate care; she reported insomnia, intrusive thoughts of harming herself and the children, and worsening symptoms. She briefly entered inpatient treatment at McLean Hospital in early January 2023. Both Clancy and Patrick Clancy have filed civil lawsuits alleging medical negligence contributed to the tragedy.


Deliberations grew tense. The jury reported deadlock more than once. The judge issued a “Tuey-Rodriguez” instruction urging them to continue. A note from the foreperson indicated one juror may not have been applying the court’s instructions on reasonable doubt. Reddington sought to have that juror questioned or removed and, on Friday, received one hour to file an emergency petition with the Massachusetts Supreme Judicial Court. The high court denied the request. Sullivan then declared the mistrial.


Clancy remains in custody at Tewksbury State Hospital. A status and trial-assignment hearing is scheduled for September 29, 2026. District Attorney Cruz said he will decide “in the near future” whether to retry the case on first-degree murder charges or pursue other options; there is no statute of limitations on first-degree murder. Reddington has said he is prepared to proceed quickly and may file additional motions, including a request for a required finding of not guilty. Legal observers generally expect a retrial given the nature of the charges.


Patrick Clancy, who has since divorced Lindsay and remarried, has publicly described his children as “the essence of my life” while also expressing that his former wife was mentally ill. The case has drawn intense national attention and renewed debate over postpartum mental health care, diagnosis of psychosis versus severe depression, and how the criminal justice system should treat mothers who kill their children while in psychiatric crisis.
